Personal injury or accident cases are almost exclusively handled on a contingent fee basis.  A contingent fee is when the attorney fee is based upon a percentage of the recovery for the client and is only paid when money is actually paid by the defendant.  If the case is unsuccessful and there is no recovery, there is no attorney fee.  Out of pocket expenses or costs may still have to be paid even when there is no recovery. 

A complicated or catastrophic personal injury case can take an extended period of time to complete.  A contingent fee arrangement allows the client to avoid paying attorney fees while their case is pending and guarantees that a fee will be paid only if there is a recovery.  This is a significant benefit to the client.  Your money can be spent on things other than attorney fees while your case is pending.

Contingent fee agreements are not appropriate or even legal for all types of cases.  For example, contingent fee agreements are unlawful in criminal and
dissolution of marriage cases.  Hourly rates and fixed retainer fees are alternatives to contingent fees.
