Work related injuries are filed with the Missouri Department of Labor and Industrial Relations, Division of Workers Compensation and not the court. The local Workers' Compensation Office at 3311 Texas Ave in Joplin is located just across the street from the Texas Ave entrance to my office.
While exceptions do exist, if you are at work and get hurt your recourse for recovery will probably be through the Division of Workers' Compensation. Exceptions can exist when an employer is not within the workers' compensation system if you are not an employee or if your injury can be attributed to someone other than your employer. For example, if injured by a machine at work you can pursue your rights through the Division of Workers' Compensation against your employer and you may have an independent claim through the courts against the manufacturer of the machine of you can prove the machine was a dangerous or defective product.
Legislatures across the country adopted Workers' Compensation laws in an attempt to streamline the claim process for injured workers by taking those claims out of the court system. In general, a broader scope of injured employees are able to recover through Workers' Compensation as compared to cases not falling within the Workers' Compensation system. Specific rules, notifications and filing requirements can be significantly different than would ordinarily apply with a court proceeding. The assistance of legal counsel early in the process is an important part of prosecuting a workers' compensation claim.
